General terms and conditions of sale
This document contains the Terms and Conditions governing your use of this website and the contract between both parties; you and us. These Conditions establish the rights and obligations of all users and those of Love Digital Factory, S.L. (hereinafter "Platanomelón") in relation to the products and services offered through this website. Please read these Terms and Conditions carefully before using or placing an order through this website. Be aware that you are bound by these Conditions, so if you do not agree to all of the Conditions, you must not place an order.
These Conditions are subject to change, so please read them before placing each order.

Love Digital Factory, S.L. (hereinafter Platanomelón) is a Spanish company with registered office in Barcelona (08039), Plaça Pau Vila 1 (Bldg. Palau de Mar, access A), CIF- B6634 9838, registered in the Mercantile Register of Barcelona, Volume 44.447, Sheet 1, Page number B-456.268, 1st inscription is the owner of the website www.platanomelon.eu and makes it available to Internet users for the aforementioned purpose.
I. Ordering, prices and product information
Ordering
Users can carry out all orders from the following website: www.platanomelon.eu. Registering on the Platanomelón website is optional, users who register or agree to create an account during the purchase of products will have access to special offers, as well as the possibility of accumulating points with each purchase.
Each customer declares that they have full capacity to use credit cards and that they have sufficient funds to cover all costs resulting from the purchase of products through Platanomelón. In this sense, the user declares that they are of legal age or, failing that, have sufficient legal capacity to contract the products and services of Platanomelón.
By pressing the "Pay" or “Buy Now” button during the purchasing process, the member declares to accept fully and without reservations all of the present General Conditions of Sale.
The data recorded by Platanomelón are proof of transactions made between Platanomelón and their clients. Platanomelón will confirm your order by sending an email.
The contractual information is presented in Spanish and will be confirmed upon of delivery at the latest.
Prices and product information
The prices of our products are inclusive of all taxes, but do not include transportation costs. There is no minimum purchase amount at Platanomelón.
Platanomelón reserves the right to modify its prices at any time, but the products and services will be invoiced on the basis of the rates in force at the time of registration of the orders (subject to availability of the product).
By placing an order with Platanomelón, the user or customer declares that they have read and understood all the information relating to the products purchased. This information can be found on each product page, and includes a general description of the product's functioning or characteristics, as well as technical details on the use and maintenance of the product for its correct operation.
II. Availability
Platanomelón will do its best to please all its customers in the demand for the products.
In case of unavailability of the product after the order has been made, the customer will be informed by email of cancellation of said product.
As a result of this demand, the speed of the return to the customer’s bank account will depend on the type of bank card and the conditions of each bank. These terms are again specified in the "Shipping and Delivery of Purchase" clause.
III. User Responsibility
The User agrees to comply with these Terms and Conditions.
The Users will be obliged to make a reasonable use of the website and its contents, under the principle of good faith and with respect to current legislation, good customs and public order.
Likewise, the User undertakes not to defame, store, spread from the website or on the website any content, material or information of a pornographic, threatening, xenophobic or violent nature, or that infringes on race, sex, religion and/or ideology or on morality, public order and fundamental rights, as well as on public liberties, honour and privacy.
Users shall refrain from using the contents of the website for illicit purposes or effects that are harmful to the rights or interests of third parties, or in any way that may damage, render useless, affect or harm the website, its contents and services. Platanomelón reserves the right, without prior notice, to exclude from its registers those Users who it considers to be making inappropriate use of the website or who it considers to be in breach of the terms and conditions of this document.
Likewise, the User undertakes to store the identifying password to make use of the services provided on the website, and undertakes not to share it with third parties, assuming personal responsibility for any damage arising from the improper use of the password or the use of the website.
IV. Payment
The price of the different products that the User can purchase on Platanomelón will always appear in euros and includes the applicable taxes. Shipping costs will be included in the final price, and the user will be informed of each of the costs in detail at the end of the purchase.
Purchases can be made via bank card (credit and debit card, VISA, MasterCard or American Express), PayPal, Amazon Pay, Apple Pay, Klarna and on delivery.
The availability of all these payment methods is subject to the discretion of Platanomelón at all times. Some payment methods may not be available temporarily or depending on the country or location of purchase.
By placing an order on Platanomelón, you are accepting the terms and conditions and privacy policy of our service providers or payment gateways. For more information, you can read our terms and policies found on the following list:

Platanomelón reserves the right to block any purchases that any of our payment providers believe to be fraudulent.
We accept the following bank cards: Visa, MasterCard and American Express. The purchase price will be debited from the customer's bank account within 1 day from the order date and the order will be considered effective after confirmation of your agreement from the bank payment centres.
In the event that the POS (Point of Sale Terminal) informs the customer that the card has been declined, the order will be automatically cancelled, and the customer will be informed of this cancellation online.
Once payment has been completed, you will receive an email from Platanomelón, in your email account provided for this purpose, informing you that the purchase and payment have been made correctly.
After placing your order, you can request a paper invoice by sending an e-mail to the following address: hello@platanomelon.eu. Failing this, you may request that the invoice be sent in electronic format by the same means or, where applicable, revoke your consent to receive the invoice in electronic format by sending us an email to the address indicated at any time.

V. Security
Platanomelón relies on the leading e-commerce platform, Shopify (https://www.shopify.com). Shopify ensures secure payments by being PCI Compliance Level 1.
All of our payment gateways – Stripe (tarjetas Visa, MasterCard, American Express), PayPal, Apple Pay and Amazon Pay – as well as Shopify, are PCI Compliance Level 1.
This means that the bank details entered are encrypted and securely transmitted to the payment gateway servers and then verified with the issuing bank to prevent fraud and abuse.
This data entry procedure is guaranteed by 256-bit SSL (Secure Sockets Layer) encryption technology, one of the most advanced and effective protection systems currently available, and, thanks to which, no third party will have access to the banking data entered by the customer via the Internet.
Only Shopify and the aforementioned payment gateways have access to the bank details linked to these payment methods, Platanomelón does not have access to them at any time.
VI. Shipping and Delivery of Purchase
Deliveries are made within the EU. Users can check whether their postal address is within Platanomelón's delivery zones when they include their details (delivery address) in the order form.
The supplier will send the products to the distribution warehouse, from where the products will be shipped to the final destination; the address set in the order form by the buyer. Each time an order is to be shipped, the buyer will receive an email informing them that their goods have left the warehouse.
Transport costs shall be charged to the buyer.
The delivery could be carried out at any time of the day, Monday to Friday, 8 am to 8 pm.
For deliveries at specific times, such as before 10 am or 2 pm, additional charges may apply.
The estimated delivery times announced on the website may be subject to change due to causes beyond the control of Platanomelón, and under no circumstances are these dates binding or guaranteed.
The purchase order corresponding to the order will be available on Platanomelón once the payment has been confirmed, and which can be viewed via the link: “My Orders”, once an email has been issued. This original purchase order includes delivery costs and VAT.
Platanomelón will ask its customers to choose the place of delivery, specifying where they want the product to be delivered – whether it is their home, office or a centre – where they will receive it and when, depending on the availability of the product, as well as the transport agency.
Platanomelón will inform the customer of when the order leaves the distribution warehouse via email.
Each delivery is considered to have been completed as soon as the product is made available to the customer by the carrier, as evidenced by the control system used by the carrier. It is up to the recipient to check the order at the time of delivery and to make any reservations and complaints that may appear justified, including the possibility of refusing the package if it has been opened or if there are obvious signs of damage.
Reservations and complaints must be sent to Platanomelón by email to the address found on the Platanomelón website.
VII. Right of withdrawal
You have the right to withdraw from this contract within 365 calendar days without providing any reason.
The withdrawal period shall expire 365 calendar days after the day on which you or a third party, other than the carrier, indicated by you acquired the physical possession of these goods. To exercise your right of withdrawal, you must notify us of your decision to withdraw from the contract via our contact form. You may use the withdrawal form below, although its use is not obligatory.
In order to comply with the withdrawal period, it is essential that the communication concerning your exercise of this right is sent before the expiry of the withdrawal period.
Consequences of withdrawal
In the event of withdrawal by you, we will refund all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a mode of delivery other than the least expensive mode of standard delivery offered by us) without undue delay and in any event no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will carry out such refund using the same means of payment used by you for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any charges as a result of the refund. We may withhold the refund until we have received the goods, or until you have provided proof of return of the goods, whichever condition is met first.
You must return or deliver the goods directly to us at the address provided by us within mainland Spain, without undue delay and, in any event, no later than 14 calendar days from the date on which you communicate your decision to withdraw from the contract to us. The deadline shall be deemed to have been met if you return the goods before the deadline has expired.
You shall bear the direct cost of returning the goods. If you wish, you may request a shipment label for the return of the goods at a cost of €4.99 (including VAT) which will be deducted from the total refund amount of your order.
You shall only be liable for any reduction in value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and operation of the goods.

Exclusion from the right of withdrawal for certain goods
In accordance with the legal regulations in force, the right of withdrawal shall not apply to contracts relating to:
a) The supply of goods that are likely to deteriorate or expire quickly.
b) The supply of sealed goods that are not suitable for return for reasons of health or hygiene protection and that have been unsealed after delivery, including but not limited to intimate hygiene products, erotic toys, vibrators, menstrual cups, lingerie or any other similar product that complies with the above criteria.
c) The supply of content goods in both physical and digital format, such as guides, films, CDs/DVDs or books.
VIII. Guarantee
The guarantees and after-sales services will be governed by Royal Legislative Decree 1/2007 of 16 November approving the text of the General Law for the Protection of Consumers and Users. Before carrying out a return, you must contact Platanomelón via email at hello@platanomelon.eu and indicate your order number. In the event that an item does not work properly or is defective, it may be exchanged for a similar or equivalent item.
The guarantee period for the products shall be 3 years from the date of delivery. Some brands have a direct guarantee on their products, in which case the customer will be provided with the means of contact to be able to exercise this guarantee within the time limits offered.
The cost of a return is free for the user while under guarantee. This includes shipping costs as well as costs related to labour and materials.
Defects caused by negligence, impacts, improper use or manipulation, unsuitable voltage, incorrect installation, or materials subject to wear and tear due to normal use are not covered by the guarantee. Defects due to failure to follow the instructions indicated on the website of each product or in the basic operating instructions included with the product at the time of delivery are also not included in the guarantee.
The consumer must inform Platanomelón of the non-conformity of the product within two months of becoming aware of it, with the consumer being liable for any damages or losses caused by a delay in communication.
IX. Intellectual and Industrial Property
The content related to the Platanomelón brand, domains, logos, drawings or documentation, including software, computer programmes, or any element that may be subject to protection by Intellectual or Industrial Property legislation, which may be accessible to Users, are the property of Platanomelón or of the natural or legal persons who are informed.
Platanomelón states that they are not the owner of all brands and logos that can be found on the website. The use of these is necessary to indicate the origin of the product. In this regard, the User may only make use of such material in the manner expressly authorised by Platanomelón or by those who have granted us a licence for its use.
Likewise, the User undertakes not to remove, delete, alter, tamper with or in any way modify:
- Any notes, inscriptions, instructions or symbols that either Platanomelón or the legitimate owners of the rights incorporate into their properties in terms of Intellectual or Industrial Property (such as, for example, copyright, ©, ® and ™, etc.)
- The technical protection or identification devices that the Intellectual or Industrial Property material may contain (e.g. watermarks, fingerprints, etc.).
The User acknowledges that, by means of these Conditions, Platanomelón neither assigns nor transfers to the User any Intellectual and/or Industrial Property rights, or any rights of third parties. Platanomelón only authorises the user to access and use them in accordance with the terms indicated in these terms and conditions.
Users are not authorised to copy, distribute (including by email and Internet), transmit, communicate, modify, alter, transform, transfer or, in any other way, carry out activities that involve the commercial use of the Intellectual and/or Industrial Property rights, either partially or totally, without the express consent, granted in writing, of the legitimate owner of the exploitation rights.
Access to and use of the website shall always and in all cases be for strictly personal and non-commercial purposes.
Platanomelón reserves all Intellectual and/or Industrial Property rights to which it is entitled, including any authorisation and/or licence.
Platanomelón does not grant any other licence or authorisation of use of the Intellectual and/or Industrial Property rights to the User other than that expressly detailed in this clause.
Platanomelón reserves the right to terminate or modify at any time and for any reason the licences granted under these terms and conditions. This notwithstanding, Platanomelón may take legal action against any use by the user that:
- Does not conform with the Conditions of Use specified here;
- Infringes or violates the Intellectual or Industrial Property rights, image or other similar rights of Platanomelón or any other legitimate third party owner; or infringes any applicable regulations.
X. Responsibility, disputes and applicable law
The client or buyer declares to be aware of the data and characteristics of the products purchased, and is in agreement with the information provided by Platanomelón. The client states that:
- You are a person of legal age according to the legislation in force.
- You are authorised to use the account, card or payment method provided to make the purchase.
- You declare that you know and consent to the receipt of the product at the place and in the conditions specified during the purchasing process.
- The data that has been reported during the process is correct and completely true, and that you are aware of the information about the products.

Platanomelón cannot be held liable for failure to fulfil the contract concluded in cases of force majeure, total or partial disruption or strike, in particular of postal services and means of transport and/or communications, flood or fire. In the event of a dispute, the member shall give priority to Platanomelón in order to reach an amicable solution.
These General Terms and Conditions are governed by Spanish law. At their choice, the parties shall submit to the courts and tribunals of the user's residence to resolve disputes, waiving any other jurisdiction that could be applicable.
ALikewise, the user may amicably resolve any incidents that may arise during the contractual relationship through the Platform operated by the European Commission https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=EN.
XI. Third-party links
You will be able to view and access links that will appear while you are using the Platform and which will redirect you to platforms outside of Platanomelón. The User may use these links to consult relevant information, such as regulations related to contracting and company websites, among others.
Platanomelón is not responsible for these linked sites, nor for the information they provide or advertise. Likewise, Platanomelón does not guarantee the quality or veracity of the services and products offered through these links. None of the companies / professionals advertised on the Platform belong to Platanomelón and, consequently, Platanomelón is not responsible for any action taken by the owners of these platforms.
XII. Modifications of the general terms and conditions of sale
Platanomelón reserves the right to modify the general conditions of sale without prior notice, being able to change, suppress or add both the contents and services that are provided through it and the way in which they appear presented or located in their servers.
These changes must be accepted by the User each time they make a purchase through the Platanomelón page.
Platanomelón members who do not conform to the modifications of the general conditions must notify and, as of the date on which the new version will take effect, shall cease to use Platanomelón services. In the event any of the terms of the general conditions are illegal or unenforceable, it shall be null and void and the terms agreed by the parties will be applied, and, failing that, what is stated in the Spanish Civil Code.
XIII. Electronic notifications
Platanomelón may contact users at any time through all available channels, according to the information provided by the user, such as email, telephone, SMS or WhatsApp, among others.
