3. What personal data do we collect and process, and for what purpose?

At Platanomelón we only collect and process data that you voluntarily share with us. You don't have to give us any personal information, but if you choose not to, you may not be able to buy from us, and your shopping experience with us may be less than optimal. However, this is your choice. And we respect it.

Furthermore, please note that the provision of personal data requires a minimum age of 18 years or, where applicable, sufficient legal capacity to enter into a contract.

EThe data we may collect and process about you includes the following:

 

  • Identifying information:  your name, address and contact details – This information includes your email address, mobile phone number, billing address and shipping address. This information is essential, for example, to be able to enter into a purchase contract with you (more information on the Terms and Conditions page), psend you your orders, inform you of their status, send you your invoice/receipt of purchase, notify you of any incident related to your orders or ask you for additional information if it is not complete in order to be able to process your purchase. We will only ask you for your ID number when the shipments are to be sent to the Canary Islands. If you wish, and if you expressly give us your explicit consent during the purchasing process, we will use your email address to send you newsletters with content developed by our sexologists or commercial information about new products or offers. If necessary, we will use email, SMS, or WhatsApp to notify you. If you do not wish to be contacted by any of these channels, please contact us before making your purchase.
  • Technical information – This information includes technical details about the device(s) you use to visit our website (device type, IP address, screen size, pages viewed, source page, time on page...) and details of how you use our website. This information is essential in order to protect our website (and therefore your personal data), as well as to improve our website and adapt its settings to your preferences and needs. We also use this information for analytical purposes, to make our website as intuitive as possible and navigation easier for you.
  • Your payment information (in part) – Don't worry, for your security, we do not store on our servers nor do we have access to your full credit/debit card number (only the last 4 digits), let alone the CVV of your credit/debit card. As for other alternative payment methods such as PayPal, Amazon Pay, Apple Pay or Klarna, we only have the linked email with which the payment has been made, nothing else. This information is indispensable for collecting payments, making refunds, and preventing or detecting possible fraud with stolen or lost cards.
  • Your purchase history – We keep a record of your purchase history with us in order to provide you with the best customer service, assistance in case of problems, to manage refunds or returns, or suggest products that may be of interest to you (always with your explicit authorisation).
  • Your contact history with us – We keep a record of your contact history with us, whether via email, SMS, WhatsApp, or Chat, in order to provide you with the best possible customer service, as well as to train our teams.
  • Your review of our products – When you leave a review about one of our products, we store it so that we can show it to users/customers who may be interested in said product. In this case, we only collect your name, your email address, your rating of our product and your comments about it. Your email address will never be shown on the page. Your name will be displayed (first name only, not surname), but if you wish you can make up a nickname or request that the rating be anonymous at the time of posting.
  • Information you provide in order to book an online consultation with our sexologists – That is, identifying information: name, surname, email address and age, as well as other relevant information to meet your request.
  • Information you provide us with to join the Platanomelón Club – That is, identifying information: name, surname, email address and password.
  • Information you provide us with to become a member – That is, identifying information: name, surname, email address and password.

Optional information that you provide us with:

  • Your date of birth – Optionally, you can provide us with your date of birth to accumulate more points (meloncitos) at part of our points programme. This information will only be used for statistical and analytical purposes of our users.
  • Information about your gender – Optionally, you can provide us with your gender to accumulate more points (meloncitos) at part of our points programme. This information will be used for statistical and analytical purposes of our users, as well as to be able to recommend personalised products to you.
  • Information about your sexual orientation – Optionally, you can provide us with information about your sexual orientation in order for us to recommend products and services according to your needs and preferences. In any case, this information will only be used for these purposes.
  • Any personal data you provide us with through our Chat – We provide this section so that you can make any queries you wish. In any case, we will only use this information to answer your questions at that time.

 

We ask you to provide true, accurate and complete information about your identity and legitimacy. We also ask you to keep us updated on your details.

If you provide us with any false, inaccurate, or incomplete information, we may deny you present or future access to and use of our platform or any of our content and/or services.

Likewise, we recommend that you keep your password safe in order to use our services and that you do not share it with third parties.

 

4. What is the legitimacy for the processing of your data?

  • Express consent: by registering on our platform to accumulate points for each of your purchases (Loyalty Programme). We will also ask for your express consent for the following purposes: subscribing to the newsletter, sending commercial communications, answering your queries and/or requests, earning money as a member, booking appointments with employees (sexologists) and answering surveys (quizzes).
  • Legitimate interest: carrying out the necessary checks to detect and prevent possible fraud when registering to accumulate points, as well as handling your requests or queries and provide the proper service.
  • Implementation of the contractual and/or pre-contractual relationship: your data is necessary for the implementation of the services you have contracted, as well as to manage your purchases, order deliveries and possible problems that may arise. .

 

5. Do you use Cookies?

6. How long is your data kept for?

What is fair and necessary. We will not keep your data for longer than is strictly necessary to fulfil the purposes for which it is being processed. In determining the appropriate retention period for your data, we will take into account the amount, nature and confidentiality of your personal data, the purposes for which we process it and whether we can achieve those purposes by other means.

In general, for customers who have made a purchase, the minimum retention period of their data on our systems will be 2 years, coinciding with the 2-year guarantee period for our products under European consumer guarantee regulations. In this way, and if the necessary conditions are met, we can offer you a replacement or refund free of charge whenever necessary.

Your personal data obtained for the sending of commercial communications and/or newsletters will be kept until you decide to revoke your consent and request to unsubscribe from this service.

When we no longer need to use your personal data, we will remove it from our systems and records or anonymise it so that we can no longer identify it.

7. Who is your data shared with and why?

We do not, nor will we ever, sell your data to third parties. We want to earn and keep your trust, and we believe this is absolutely essential in this respect.

That said, in order to provide you with the best possible service and experience, we need the help of the best providers, which is why we feel it is essential to share some of your details with the following types of companies:

 

  • Companies that carry out activities to deliver your purchases, such as payment service providers, warehouses, order packers and transportation companies. For example: Stripe, Klarna, AmazonPay, Correos, Correos Express, Sending or DHL, among others.
  • Companies that develop technical resources for the support and access of this website or any of its features. For example: Shopify or DigitalOcean, among others.

  • Credit reference agencies, security agencies and fraud prevention agencies so that we can tackle fraud.
  • Group companies, as sometimes different companies of our group are in charge of different activities, which will not involve direct commercial actions towards users.
  • Social networks that help us create personalised audiences from personal data files, allowing us to create a targeted audience for our advertising campaigns. For example: Facebook and Instagram.

We may provide aggregate information and analytics about our users or customers to third parties, but before we do so, we ensure that they are non-identifying through a procedure that anonymises the data.

In order to be able to offer you Klarna's payment method, we may pass on your personal contact details and order details to Klarna during the checkout process so that it can assess whether you qualify for Klarna's payment methods and adapt them to each user. The personal data transferred is processed in accordance with Klarna's privacy policy.

We guarantee that all third parties with whom we share your data comply with the European General Data Protection Regulation (GDPR). Transfer of international data

In some instances, some of our suppliers may have their servers outside the European Economic Area (EEA).

Therefore, and in compliance with article 34.5 of the LOPD and 66.2 of the RLOPD, we inform you that in the event that the data provided by you are transferred or stored outside the European Economic Area (EEA), you will be expressly accepting the necessary transfer of international data to the international servers of said Platanomelón suppliers, the sole purpose being the storage of the data on the servers, and strictly necessary to be able to provide you with the service.

For information purposes, and without excluding those not listed here, some of the Platanomelón providers with international servers are Shopify, Google, Stripe, PayPal, Apple Pay, Amazon Pay, Klaviyo, Klarna and MailChimp. In any case, all international transfers will be carried out on the basis of Standard Contractual Clauses (STCs), after an assessment of the circumstances of the transfers and the additional measures we will apply, as well as the guarantees we will require from these suppliers to ensure an adequate level of protection of the data transferred.

The security of your data is our top priority.
